ON OR ABOUT 3/27/1996, RESPONDENT REMOVED FROM SERVICE FOR DISPOSAL, TWO DRUMS OF PCB WASTE AT CONCENTRATIONS OF 50 PPM OR GREATER. THE PCB WASTE WAS SHIPPED ON 8/1/1997 AND WAS RECEIVED BY SAFETY KLEEN (COFFEEVILLE, KS) ON 8/7/1997. THE WASTE WAS DESTROYED MORE THAN ONE YEAR AFTER IT WAS REMOVED FROM SERVICE FOR DISPOSAL. THIS CONSTITUTES A VIOLATION OF SECTION 15 OF TSCA. THE PROPOSED PENALTY IS $1,000.
