DOJS APPEARANCE IN THIS MATTER IS NECESSARY TO PROTECT EPA'S INTERESTS IN HAVING ADEQUATE FUNDS AVAILABLE FOR THE COMPANY TO MEET THE REQUIREMENTS OF THE CONSENT DECREE.
