On or about April 30, 2024, an authorized representative of the EPA conducted a compliance inspection of the Tyson Fresh Meats facility located at 1500 Plum Creek Parkway, Lexington, NE 68850 to determine compliance with the Chemical Accident Prevention Provisions (Section 112(r) of the CAA and 40 C.F.R. Part 68). The facility failed to: Develop an emergency response exercise program before December 19, 2023, certify the accuracy of Operating Procedures annually, accurately compile written process safety information, coordinate annually with local emergency planning and response organizations and provide them with updated emergency response information, and document coordination activities.
