Case summary

​On August 20, 2024, Region 7 executed a Consent Agreement and Final Order (CAFO) with conditions with Roquette America, Inc. The CAFO commences and concluded the proceeding regarding alleged violations of Section 112(r) of the CAA discovered as a result of a March 22, 2022 inspection of Roquette?s facility in Keokuk, IA. The inspection report details the following violations: failure to include the appropriate flow diagrams in the process safety information; failure to promptly address process hazard analysis findings and update the process hazard analysis every five years; failure to perform compliance audits every three years and address findings; and failure to correct the risk management plan within one month of a change in the emergency contact information. During the course of negotiations, the Respondent proposed a SEP that requires Roquette to spend $122,852 to purchase and outfit two trucks as emergency response vehicles that will be donated to the local Keokuk fire department. Respondent will also pay a $207,488 penalty. The CAFO with conditions requires Roquette to resolve all open process hazard analysis and compliance audit findings within one year of execution of the CAFO and submit monthly progress reports to the EPA.
