Case summary

Filed complaint to resolve FIFRA unregistered pesticide sale. On June 16 and 17, 2021, the EPA conducted inspections at Respondent�s retail store located at 6933 W. 75th Street, Overland Park, KS 66204, and at Respondent�s headquarters/store located at 2405 Southwest Boulevard, Kansas City, MO. The inspections were conducted to determine the compliance status of Respondent with the requirements of FIFRA. The EPA has completed its review of the information collected and has determined that CBD American Shaman a/k/a Shaman Botanicals is in violation of the following requirements of FIFRA and the CFR: 1. Unregistered Pesticide: Pursuant to 7 U.S.C. � 136a(a) and 7 U.S.C. � 136j(a)(1)(A), it is unlawful for any person to distribute or sell any pesticide that is not registered under section 136a. Information gathered during the inspection revealed that the unregistered pesticides Shaman Cleaning Wash with hypochlorous acid content 0.0092%, Shaman Cleaning Wash with hypochlorous acid content 0.0046%, Shaman Cleaning Wash with hypochlorous acid content 0.02%, and Shaman Cleansing Gel, hypochlorous acid content 0.0046%, were being distributed or sold in violation of to 7 U.S.C. � 136j(a)(1)(A).
