Respondent has sold, distributed, offered for sale and has the ability to produce a product for sale at an establishment that is not registered under FIFRA 7 USC 136(a), in violation of Section 12(a)(1)(A).46 counts of distributing unregistered pesticides (disinfectants) and one count for production in an unregistered establishment. They distributed these products to Hy-Vee stores in our region and one in R5 in Marshall, MN. We have issued IRLs, a SSURO, a Pre-File Letter and a Civil Complaint to this firm. It was finally determined that this company was out of business and did not have the ability to pay the proposed penalty. CAFO has a $0 penalty.
