Case summary
EPA conducted an investigation of the Facility on February 25, 2026, to determine Respondent's compliance with Section 112(r) of the CAA, 42 U.S.C. ? 7412(r), and 40 C.F.R. Part 68 (the Investigation ). Prior to July 23, 2023, Respondent's predecessor in ownership operated the plastics material and resin manufacturing process at the Facility, meeting the definition of process , as defined by 40 C.F.R. ? 68.3.On January 10, 2026, EPA RMP Reporting Center sent a letter to Respondent, notifying Respondent of its failure to update the RMP on file with EPA for the Facility. Based on the information provided by the Respondent, the Facility no longer had a regulated substance present in more than the applicable threshold quantity onsite.
