Case summary

EPA has conducted a comprehensive review of the facility-specific information gathered based upon observations made from the OGI video captures, facility permitted operations, and information provided by Respondent. Based on this review, EPA has made the following findings for the Facility: a. Respondent violated the TCEQ Non-Rule Standard Permit for Oil and Gas Facilities (e)(1) by failing to ensure that facilities that have the potential to emit air contaminants were maintained in good working order and were operating properly during facility operations. b. Respondent violated 30 Tex. Admin. Code 116.615(2) by failing to operate equipment consistent with the operating procedures set forth in the applicable permits. c. Respondent violated 30 Tex. Admin. Code 116.615(9) by failing to ensure that all air pollution emission capture and abatement equipment was maintained in good working order and operating properly during normal facility operations. d. Respondent violated the TCEQ Non-Rule Standard Permit for Oil and Gas Facilities (c)(2)(B) by failing to comply with applicable 40 CFR, Part 60 requirements for NSPS. e. Respondent violated 40 CFR 60.112b(a)(2)(ii) by failing to maintain external floating roof openings with a gasketed cover, seal, or a closed lid with no visible gaps. f. Respondent Violated 40 CFR 60.113b(b)(4)(ii)(C) by failing to operate the tanks external floating roof without holes, tears, or other openings in the shoe, seal fabric, or seal envelope.
