EPA has conducted a comprehensive review of the facility-specific information gathered based upon observations made from the OGI video captures, facility permitted operations, if applicable, and information provided by Respondent. Based on this review, EPA has made the following findings for the Facility: a. Respondent violated 30 Tex. Admin. Code 106.8(c)(2) by failing to maintain records containing sufficient information to demonstrate compliance with all applicable general requirements of 30 Tex. Admin. Code 106.4 of this title or the general requirements in effect at the time of the claim; and all applicable PBR conditions. b. Respondent violated 30 Tex. Admin. Code 106.8(c)(3) by failing to keep all required records at the Facility site, or at an office within Texas having day-to-day operational control of the plant site if the Facility normally operates unattended. c. Respondent violated 30 Tex. Admin. Code 106.8(c)(4) by failing to make the records available in a reviewable format at the request of personnel from the commission or any air pollution control program having jurisdiction.
