Case summary

The enclosed Order alleges violations of the facility?s EPA-issued Concentrated Animal Feeding Operation (CAFO) Permit. The violations alleged were identified by New Mexico Environment Department (NMED) and EPA inspectors during the August 01, 2025, compliance evaluation inspection of the facility. The violations alleged include, but are not limited to, the following: 1. Holes were identified in the roof of the commodities storage area, allowing precipitation runoff to become contaminated. Additionally, feed, silage and hay storage areas were uncovered and exposed to the elements. 2. Berms were not properly designed, constructed, operated, and maintained to contain the 25-yr/24hr rain event. Also, we observed wastewater pools in different areas of the pens. 3. The retention control structure (RCS) had no liner or certification of hydraulic conductivity. 4. Sediment solids build up and vegetation overgrowth inside the RCS.
