On October 2, 2025, EPA Region 6 entered into a Consent Agreement and Final Order (CAFO) under its authority pursuant to the Toxic Substances Control Act (TSCA) with Clean Harbors Deer Park LLC (Respondent) located in La Porte, TX. The CAFO was issued in response to the following alleged violations of TSCA by Respondent: 1) Failure to Store Polychlorinated Biphenyl (PCB) Items and PCB Containers in an Easily Identifiable and Readable Manner; 2) Failure to Label PCB Items, PCB Transformers, and/or PCB Containers with the Appropriate PCB ML Mark; 3) Failure to Label PCB Storage Areas with the Appropriate PCB ML Mark; 4) Failure to Mark PCB Items and/or PCB Containers with the Removed from Service Dates; 5) Failure to Inspect PCBs Every 30 Days; 6) Failure to Provide Adequate Roof and Walls to Prevent Rainwater from Reaching the Stored PCBs and PCB Items in the PCB Storage Area; and 7) Failure to Submit an Annual Report that Accurately Includes PCB Waste Generated by the Operator who Disposes of his/her Own Waste. The CAFO requires Respondent to pay a civil penalty of $46,537. The alleged violations have been corrected.
