EPA conducted an investigation of the Facility on June 25, 2025, to determine Respondent's compliance with Section 112(r) of the CAA, 42 U.S.C. ? 7412(r), and 40 C.F.R. Part 68 (the Investigation ). Respondent failed to submit an updated RMP for the Facility by the required due date of June 18, 2024. Based upon the information gathered during the Investigation, EPA determined that the Respondent violated certain provisions of the CAA.
