Case summary

EPA conducted an investigation of three Facilities on March 5, 2025, to determine Respondent's compliance with Section 112(r) of the CAA, 42 U.S.C. ? 7412(r), and 40 C.F.R. Part 68 (the Investigation ). Respondent failed to submit an updated RMP for the Facilities by the required due date of October 16, 2023. Based upon the information gathered during the Investigation, EPA determined that the Respondent violated certain provisions of the CAA.
