EPA v. Sundance Dental Care of Grants Dental Amalgam AO

Case summary

On September 19, 2025, EPA-R6 issued Administrative Orders (AOs) to Sundance Dental Care of Grants, in Grants, New Mexico. The AO was issued under Section 309 of the CWA for failure to submit a One-Time Compliance Report (OTCR) as required by the Dental Office Point Source Category Pre-Treatment National Effluent Guidelines. Dental facilities in New Mexico were required to submit a OTCR to EPA certifying whether they have installed treatment to remove dental amalgam, due to its mercury content, by October 2020. Each facility must respond to EPA within thirty (30) days of the effective date of the order with their OTCR. This is a continuation of the regional NPDES Dental Facility Enforcement initiative in NM for failure to to comply with this regulation that started in FY2021.
