Case summary
During the week of January 2, 2024, a Proposed Administrative Complaint will be issued to Northcote Cleveland, LLC (Respondent). The Proposed Complaint alleges Respondent violated regulations set forth at 40 C.F.R. 147.2903(b), 147.2909 and 147.2912 by maintaining the injection well in a manner that could allow the movement of fluid that contains contaminants into an USDW, by failing to successfully demonstrate mechanical integrity and failure to comply with Final Administrative Compliance Order: SDWA-06-2023-111. EPA Region 6 hereby proposes to assess against Respondent a penalty of $ 12,500.00. Additionally, EPA requires Respondent fix the well, apply for a EPA UIC permit and successfully demonstrate mechanical integrity or properly plug the well or convert it to production use. Respondent has 30 days to respond.
