The week of December 4, 2023, EPA Region 6 issued an Expedited Settlement Agreement (ESA) under its authority pursuant to the Resource Conservation and Recovery Act (RCRA) to Heavy Duty Equipment ( HDE ) located in Brownsville, TX. The ESA was issued in response to violations of: (a) Failure to perform an accurate hazardous waste determination (b) Failure to meet Used Oil management standards. The ESA requires HDE to: (a) correct the alleged violations, as applicable, and has submit true and accurate documentation of such correction along with this Agreement; (b) submit payment of the $2,500 civil penalty; and (c) has submit a true and accurate proof of payment of the civil penalty along with this Agreement. TGT must respond to EPA Region 6 within thirty (30) days of receipt of the request for settlement.
