The enclosed Order alleges violations of the concentrated animal feeding operations (CAFO) permit issued by the EPA. The violations alleged were identified by an EPA inspector during a March 16, 2023, compliance evaluation inspection of the facility. The violations alleged include, but are not limited to, the following: 1.EPA observed several low spots in the manure stockpile berm on the northern and eastern side; 2.Liquids from lagoons were not being land applied at an agronomic rate; 3.The ?freshwater pond? which collected runoff from the land application fields was not designatedas a lagoon nor did it have a liner certification; 4.Staff gauges in the lagoons were missing, needing maintenance or were not visible for the 25-year,24-hour rainfall event; 5.Lagoons were not entirely enclosed by fences, which are required to keep livestock out.
