Case summary
On July 24, 2023, EPA Region 6 issued an Administrative Order under its authority pursuant to Section 309 of the Clean Water Act to the City of Gallup, New Mexico Wastewater Treatment Plant. The AO was issued in response to NPDES Permit significant non-compliant effluent limit violations, whole effluent toxicity test violations, and operating without a permit. The AO requires the facility to 1) submit a list of specific actions taken to correct the violations and 2) submit written certification to EPA that the violations have been corrected and the facility is compliant with its permit. The Respondent must respond to EPA Region 6 within thirty days of the effective dated of the AO.
