On October 2, 2023, EPA Region 6 issued an Administrative Compliance Order on Consent (ACOC) under its authority pursuant to <Enter Regulatory Authority> to Phillips 66 Pipeline LLC located Pasadena, Texas. The ACOC was issued in response to violations of (1) Respondent did not file with EPA or Texas an adequate and timely notification of its hazardous waste activities at the facility during the period 2020 in violation of Section 3010(a) of RCRA, 42 U.S.C. ? 6930(a); (2) Respondent failed to operate within its stated generator status during portions of 2020, in violation of one or more of the requirements for very small and small quantity generators under 30 TEX.ADMIN.CODE Chapter 335, Subchapters C and 40 C.F.R. ? 262.34. The ACOC requires the Respondents to certify that it has assessed all of its solid waste streams to determine the accurate waste codes and has developed and implemented Standard Operating Procedures (?SOP?) to ensure that it is operating in compliance with RCRA regulations within 30 days of the effective date of the ACOC.
