Case summary

On April 20, 2023, EPA Region 6 issued a Consent Agreement and Final Order (CAFO) under its authority pursuant to Section 3008(a) of the Resource Conservation and Recovery Act (?RCRA?), 42 U.S.C. ? 6928(a)(2) to the United States Department of Veteran Affairs. The CAFO was issued in response to violations related to (1) the facility?s failure to file an adequate and timely notification of its hazardous waste activities with the EPA or Louisiana in violation of Section 3010(a) of RCRA, 42 U.S.C. ? 6930(a), and (2) failure to comply with the manifest requirements in 2019 and 2020, in violation of LAC 33:V.1107, [40 C.F.R. Parts 262]. The CAFO requires the Respondent to pay a penalty of twenty-four thousand and thirty-one dollars ($24,031) within 30 days of issuance. Also, the Respondent must respond to EPA Region 6 with a statement certifying compliance with Section 3010 of RCRA and that it is accurately monitoring and recording its hazardous waste generation pursuant to 40 C.F.R. ?? 262. 11 and 262.13 within 60 days of the effective date of the CAFO
