Case summary

On November 17, 2022, EPA, Region 6 (?R6?) filed a Consent Agreement and Final Order (?CAFO?) settling claims pursuant to the Resource Conservation and Recovery Act (?RCRA?) against Lowe?s at 243 locations/facilities in R6. Through R6?s data mining process and records reviews, R6 identified violations of Lowe?s failure to file RCRA notifications of Lowe?s? hazardous waste activities. Lowe?s has 30 days to pay a civil penalty of $141,729.75. The compliance projects are: 1) Standard Operating Procedures (?SOPs?) for R6?s review that will create a centralized process for all its locations in R6 and beyond; 2) Lowe?s will hire a third-party consultant that will audit its locations on an annual basis and reporting; and 3) Lowe?s will create a plan for EPA, R6?s review, which will ensure that EPA will have access to its information and that of its third-party venders, upon request. The combination of these compliance projects will support Lowe?s compliance with hazardous waste from cradle to grave. This settlement affects Lowe?s RCRA obligations and management of up to 2,913,000 kg per year of hazardous waste generated at 243 small quantity generator locations covered by this CAFO.
