Case summary

Incidents at the Facility that occurred on December 20, 2021, and May 3, 2022, resulted in accidental releases. On April 11, 2022, the EPA sent Respondent a Notice of Potential Violation and Opportunity to Confer letter. On June 24 and August 9, 2022, the EPA responded to the documentation and information received from Respondent, and determined there were two violations of Part 68 RMP requirements. As part of the settlement, Respondent shall implement a supplemental environmental project (SEP), which the parties agree is intended to secure significant environmental or public health protection and improvement.
