EPA conducted an inspection of the Facility from January 16, 2020 - January 17, 2020, to determine compliance with Section 112(r) of the CAA, 42 USC 7412(r), and 40 CFR Part 68. On February 24, 2022, the EPA sent Respondent a Notice of Potential Violation and Opportunity to Confer letter. EPA determined there were two violations of Part 68 requirements. Respondent shall implement a supplemental environmental project (SEP), which the parties agree is intended to secure significant environmental or public health protection and improvement.
