Case summary

On February 26, 2021, an accidental release of butane occurred at the facility. EPA conducted an investigation on or about August 16, 2021, to determine Respondents compliance with Section 112(r) of the CAA. On August 31, 2021, the EPA sent Respondent a Notice of Potential Violation and Opportunity to Confer letter. On September 27, 2021, the Respondent replied and conferred with EPA. EPA found that the Respondents failure to design and maintain a safe facility by not taking such steps as were necessary to prevent releases, and failure to minimize the consequences of the accidental release, are violations of Section 112(r)(1) of the CAA.
