Case summary

An Administrative Order (AO) was issued to the Port of New Orleans for violations of the Clean Water Act (CWA) 33 U.S.C. Section 1251-1387. The violations were identified during a Municipal Separate Storm Sewer System (MS4) Self-Assessment and inspection conducted on January 12, 2022. Part II B.3(E) 1 Section 6 of the permit requires Respondent to ensure legal authority to control discharges to and from those portions of the MS4 for which it has jurisdiction. Respondent failed to ensure legal authority to adequately enforce its Illicit Discharge and Detection Elimination (IDDE) program. Respondent shall provide to EPA a Corrective Action Plan and implementation schedule for EPA's review and approval that details procedures and practices that will be implemented to correct the deficiencies noted.
