Case summary
EPA Region 6 issued an Administrative Order (AO) to Delux Public Charter DBA JSX (Respondent). EPA Region 6 issued the AO under its authority pursuant to Section 1414(g) of the Safe Drinking Water Act to Respondent. The AO was issued in response to violations of the Aircraft Drinking Water Rule (ADWR). Within the Order, EPA alleges that Respondent failed to perform routine disinfection and flushing, failed to collect routine bacteriological samples, failed to develop and implement coliform sampling plans, failed to develop and implement operations and maintenance plans, failed to report aircraft to the Aircraft Reporting and Compliance System (ARCS), and failed to perform and report past-due aircraft self-inspections. As such the Order requires the Respondent to perform corrective actions including restricting all public access to aircraft water systems within 72 hours of receipt of the Order, providing alternatives to water, providing public notice to crew, developing an operations and maintenance plan, developing a coliform sampling plan, reporting all aircraft into ARCS, performing and reporting follow-up and routine disinfection and flushing, collecting and reporting follow-up and routine bacteriological samples, and completing and reporting past-due aircraft self-inspections.
