EPA v. DCP MIDSTREAM, EAGLE GAS PLANT

Final Order No Penalty

Case summary

DCP Operating Company, Eagle Gas Plant NPDES Permit Number: TX0133992 Docket No. CWA 06-2021-1709 has successfully taken steps to correct the violations federally enforceable under the Clean Water Act (CWA) cited in the above referenced Order. The above-referenced Order are hereby closed. DCP reviewed the limitations and monitoring requirements for both the EPA and RRC permits at the Eagle Plant. Sampling requirements in both permits allow for the TSS grab sample to be collected either at the concentrate/backflush water (before comingled with stormwater) or at Outfall 001. DCP took a representative sample of the concentrate/backflush water on April 14, DCP Midstream, Eagle Gas Plant (TX0133992) 2021 and compared it to the results of the discharge at Outfall 001 on April 6, 2021. The TSS levels at the outfall locations were well below the discharge levels required by the NPDES permit and the results from the April 6, 2021 sampling. Additional samples were taken on May 5, 20201 at the RO concentrate/backflush location. DCP has already implemented new sampling protocols in 2021 that have brought our effluent to discharge under the permitted daily max levels.
