Case summary

In July of 2018, EPA Region 6 began an investigation of Flipnmove Productions and EQ Media Inc. for compliance with the Lead Based Paint (LBP) provisions of the Toxic Substances Control Act (TSCA) at a renovation worksite in Boyd, TX. 94 violations of the Renovation, Repair, and Painting (RRP) Rule (40 C.F.R. Part 745, Subpart E, and Section 409 of TSCA, 15 U.S.C. Section 2689) were discovered. The Respondents failed to obtain certification prior to performing, offering, or claiming to perform renovations in target housing; failed to assign a certified renovator; failed to ensure that the renovations were performed in accordance with specified work practice standards; and failed to retain records demonstrating compliance with the RRP Rule. A Consent Agreement and Final Order (CAFO) was filed on February 3, 2021 with a civil penalty of $30,000, due within 30 days of the effective date.
