On December 31, 2019, EPA Region 6 issued an Administrative Order (AO) under its authority pursuant to Section 301 of the Clean Water Act, 33 U.S.C. 1311, to the City of Belen (Respondent) located in Valencia County, New Mexico. The AO was issued in response to the National Pollutant Discharge Elimination System (NPDES) Permit violations which were identified during a review of the NPDES permit file, discharge monitoring reports and non-compliance reports. The violations alleged are for exceeding Total Chlorine Residual, which are established in their NPDES permit effective March 1, 2015. The AO requires Respondent to take such measures as are necessary to comply with the Permit Conditions within thirty days. Respondent must respond in writing to EPA Region 6 within thirty days of the effective date of the AO.
