Case summary

On October 6, 2020, EPA Region 6 issued a Consent Agreement and Final Order (CAFO) under its authority pursuant to the Resource Conservation and Recovery Act (RCRA) to Hexion Inc. located in Batesville, Arkansas. The Hexion Inc. is a chemical company producing thermoset resins and specialty products. EPA conducted a RCRA record review of the Hexion activities as a generator of hazardous waste. A search of the facility?s history revealed they declared themselves as ?not a generator?, however, shipments of hazardous wastes originated from the facility. The CAFO was issued in response to violations for: failing to provide adequate and timely notification of its hazardous waste activities at in violation of Section 3010(a) of RCRA, 42 U.S.C. ? 6930(a), and failure to meet the requirements of its generator status as a large quantity generators under 40 C.F.R. ? 262.34/or 270.
