Case summary

On October 6. 2020, EPA Region 6 issued a Consent Agreement and Final Order (CAFO) under its authority pursuant to the Resource Conservation and Recovery Act (RCRA) to Hexion Inc. for three located Texas: Brady TX, Cleburne, TX and Diboll, TX. Hexion Inc. is a chemical company producing thermoset resins and specialty products. EPA conducted a RCRA record review of the Hexion activities as a generator of hazardous waste. A search of the facilities history revealed they were shipping hazardous wastes in quantities exceeded their registered generator status. The CAFO was issued in response to violations for: failing to provide adequate and timely notification of its hazardous waste activities in violation of Section 3010(a) of RCRA, 42 U.S.C. ? 6930(a), and failure to meet the requirements of its generator status as a large quantity generators under 40 C.F.R. ? 262.34/or 270.
