Case summary

On September 24, 2019, EPA Region 6 issued an Administrative Compliance Order on Consent (AOC) under its authority pursuant to Section 113(a)(3) of the Clean Air Act, 42 U.S.C. ? 7413(a)(3) to Equistar Chemicals, LP located in Westlake, LA. The AOC was issued in response to violations of 40 C.F.R. ? 60.18(d) for failure to monitor and have sufficient controls on assist steam flow at the Flares to ensure the Flares were properly operated and maintained in accordance with 40 C.F.R. ? 60.18(d). The AOC requires Equistar Chemicals, LP to install steam flow monitors and steam control stations at each Flare, submit a summary of the engineering assessment and engineering design work for improvements to be made at the Facility over the next several years, and replace the flare tip at the M-Line Production Area Flare to reduce the amount of assist steam necessary to cool the tip of the Flare. Equistar Chemicals, LP must respond to EPA Region 6 by the compliance dates specified in the AOC.
