Case summary

On December 19, 2018, EPA Region 6 issued an Administrative Compliance Order on Consent (ACOC) under its authority pursuant to Section 3008(a) of the Resource Conservation and Recovery Act (RCRA), 42 U.S.C. 6928, as amended by the Hazardous and Solid Waste Amendments of 1984 (HSWA), and is simultaneously commenced and concluded through the issuance of this ACOC under 40 C.F.R. 22.13(b) and 22.18(b)(2) and (3) to Evestra Inc. (EI) located in San Antonio, Texas. The ACOC was issued in response to violations of: 1. Failure to accurately notify hazardous waste generation, and 2. Failure to comply with Small Quantity Generator (SQG)requirements. The ACOC requires EI to 1. Certify that all solid waste streams have been assessed to determine the accurate waste codes and has developed and implemented Standard Operating Procedures (SOP) to ensure that its operating in compliance with RCRA and regulation requirements; 2. Certify they have accurately and adequately complied with RCRA Section 3010 Notification; and 3. Provide a copy of the SOPs along with its certification.
