Case summary

Region 5 is the lead region in this global settlement involving Regions 3, 4, 5, and 6, the Oklahoma Department of Environmental Quality (ODEQ), the Pennsylvania Department of Environmental Protection (PADEP), and the State of West Virginia, on behalf of the West Virginia Department of Environmental Protection. Region 6 facilities include Arapaho and Buffalo Creek gas processing plants in Oklahoma, and the Javelina, Carthage, Carthage East, and Hidalgo facilities in Texas. The Oklahoma Department of Environmental Quality is participating in the global settlement process. A proposed Consent Decree has been agreed to and signed by the Defendants. The settlement terms include corrective action requirements to bring the facilities into compliance with certain NSPS requirements; a penalty; mitigation projects; and, a Supplemental Environmental Project (SEP).
