Case summary

Hat Creek Energy violated the conditions of the Texas State Implementation Plan regulations which require permitting for emission sources. Hat Creek Energy failed to obtain authorization prior to operating a source of air emissions, in violation of 30 TAC 116.110(a) and (g). Respondent provided information to EPA that they have taken corrective action measures at the Facility to address compliance issues that were discovered as a result of the flyovers. Specifically, Respondent provided the following: a. On August 6, 2018, Respondent submitted an application to TCEQ to register the Facility under TCEQ's SIP-approved Permits by Rule Program for oil and gas facilities under Subchapter O of the Texas Administrative Code. b. On October 24, 2018, TCEQ issued Respondent Permit No. 152998 under TCEQ's Permits by Rule Program.
