Case summary

On August 15, 2018, EPA Region 6 issued a Consent Agreement Final Order (CAFO) under its authority pursuant to Section 113(d) of the Clean Air Act to BASF Corp. located Geismar, Louisiana. The CAFO was issued in response to violations of: 40 C.F.R. 60.11(d), 63.6(e), and/or 63.11(b)(6)(ii) at the following flares at various times from July 1, 2011, to October 15, 2014: a. EO/EG Flare/ Flare 10 a steam-assisted flare; b. Polyol Flare/ Flare 13 a non-assisted flare; c. TDI Flare/ Flare 14 a steam-assisted flare. The CAFO requires BASF Corp. to install and operate flare monitoring equipment at the aforementioned flares and conduct a mitigation project installing a new packed scrubber at the MDI-2 Plant.
