Case summary
January Environmental Services, Inc. (JES) owns and operates a used oil transportation service and a used oil storage/processing facility in Oklahoma City, OK. JES operates six other facilities in Region 6 and five other facilities located in other regions. JES advertises itself as providing hazardous waste disposal solutions since 1952 . Specific services advertised on their webpage include, recycling, industrial cleaning, waste services and emergency response. Oklahoma Department of Environmental Quality (ODEQ) inspections uncovered violations of the used oil regulations and found the facility receiving/storing hazardous waste without a permit in 2010 and again in 2013. In November 2017 and March 2019, a joint Region 6 / ODEQ inspection found a continued pattern of violations of RCRA used oil standards as well as requirements for transport and storage of hazardous waste EPA Region 6 referred the case to the Department of Justice in 2018. During trail preparation, DOJ and JES came to a settlement and a Consent Decree was entered on September 26, 2022.
