Case summary
On December 19, 2017, EPA Region 6 filed a Consent Agreement and Final Order (CAFO) with Medical City Dallas for its facility located in Dallas Texas, to resolve violations of the Resource Conservation and Recovery Act (RCRA). Data from a Texas treatment, storage and disposal facility showed that the facility failed to meet manifesting requirements. Additional investigation showed that Medical City Dallas was not meeting the requirements of their Large Quantity Generator status, including training, emergency procedures, and contingency plan. The State of Texas is aware of the Region's data mining effort and participated in training on the data mining method. The Region notified the State of the potential violations and our intention to investigate and pursue enforcement before notifying the facility by letter. The CAFO requires Medical City Dallas to certify and document compliance with all applicable RCRA requirements, and to pay civil penalties in the following amount: $40,765.60
