Case summary

On August 11, 2016, EPA Region 6 issued a Consent Agreement and Final Order under its authority pursuant to the Clean Air Act to Eastman Chemical located in Texas City, Texas. The Consent Agreement and Final Orders was issued in response to violations of: (1) flaring good pollution control practices and (2)failing to meet the minimum net heating value for the waste gas going to the flare. The Consent Agreement and Final Order requires Eastman Chemical to (1) monitor steam and flare vent gas flow rates, (2) monitoring the heating value of the vent gas, and (2) meet a minimum net heating value in the combustion zone of 270 but/scf. Eastman Chemical will also perform a Supplemental Environmental Project to reduce emissions during process start up. Eastman Chemical must comply with the flare operating standards within 120 days of the effective date of the order. Eastman is required to pay a penalty of $28,500 and is due within 30 calendar days of the effective date of this CAFO.
