Case summary

On September 01, 2016 , EPA Region 6 issued an Administrative Order (AO) under its authority pursuant to the Safe Drinking Water Act (SDWA) to Tempe Water Supply Corporation 1 (Respondent) located Livingston TX. The AO Plan Implementation was issued in response to violations of: Arsenic, Combined Radium 226 and radium 228 and gross alpha particles. Respondent requested additional time with the construction schedule. The AO implmentation plan incorporates the new construction schedule and the deadline extension request submitted by Respondent in their compliance plan. The AO requires Respondent to comply with the schedule specified in the plan: 1) Construction plans approved by engineer by August 1, 2016; 2) Start construction by January 1, 2017; 3) Complete construction and project closeout by April 1, 2017. Respondent must respond to EPA Region 6 within 120 days of receipt of this AO. On March 22, 2012, EPA Region 6 issued the original AO to Respondent for the same violations. The Original AO required Respondent to comply immediately with the referenced MCL for arsenic, combined radium 226 and radium 228, and gross alpha particles or submit to EPA 1) a detailed plan to meet the arsenic, combined radium 226 and radium 228 and gross alpha particles MCL; 2) a cost analysis of the proposed plan; and 3) a construction schedule. This AO extends the compliance deadline to April 1, 2017, and supersedes the AO issued on March 22, 2012.
