Case summary
On April 27, 2016, EPA Region 6 issued an Administrative Penalty Order (APO) under its authority pursuant to the Safe Drinking Water Act (SDWA) to Red River Authority (RRA) of Texas (Respondent) for violations at its Truscott Gilliland water system, located in Wichita Falls, Texas. The violations were for 1) exceedance of the maximum contaminant level (MCL) for nitrate, 2) monitoring and reporting violations, and 3) failure to comply with a previously issued Administrative Order (AO). EPA proposes that Respondent pay a penalty. The previously issued AO required Respondent to submit to EPA 1) a detailed plan with a modification proposal; 2) a cost analysis of the system modification; and 3) a construction schedule for the project. Respondent failed to submit a plan. The Texas Commission on Environmental Quality (TCEQ) and EPA have enforcement authority for the public water system provisions of the SDWA in the State of Texas. TCEQ and EPA have consulted regarding these Orders, and it has been agreed that EPA would initiate this enforcement action.
