Case summary

On October 24,2016, EPA Region 6 issued a Consent Agreement and Final Order (CAFO) under its authority pursuant to Section 3008(a) of RCRA, 42 U.S.C. ? 6928(a), as amended by the Hazardous and Solid Waste Amendments of 1984 to Dal-Tile Sunnyvale Manufacturing Plant located Sunnyvale, Texas (Dal-Tile). The CAFO was issued in response to violations of: 1. Failure to meet permit exemption requirements for the storage of hazardous waste, 2. Failure to meet large quantity generator status requirements, and 3. Failure to meet manifest requirements. The CAFO requires Dal-Tile to return to compliance with RCRA regulations required for their current generator status and pay a civil penalty in the amount of $53,900. Dal-Tile must satisfy the compliance order section of the CAFO within 90 days of the effective date of the CAFO and the penalty shall be paid within 30 days of the effective date of the CAFO.
