Case summary
On April 14, 2016, a Consent Agreement and Final Order (CAFO) was issued to Apex Tool Group LLC (Apex) to resolve violations of Section 313 of the Emergency Planning & Community Right-to-Know Act for its facility in Springdale, Arkansas. The violations were discovered during an investigation initiated in November of 2013, when the EPA conducted a review of Apex? reporting of toxic chemical releases and waste management. The EPA discovered six counts of failure to timely report, and four instances of data quality errors, from 2009 to 2013. Under the terms of the CAFO, Apex has corrected the violations and will pay a civil penalty of $150,000.00.
