Case summary
On October 14, 2015, EPA issued a Notice of Determination to Halcon Resources Corporation (Halcon) in response to a voluntary disclosure submitted to EPA on October 23, 2012, regarding violations discovered at the Electra Gas Plant. EPA determined that Halcon met the nine conditions of EPA's Audit Policy for violations of the Clean Air Act and Clean Water Act specified in the Findings of Fact. As such, Halcon qualifies for 100% mitigation of the gravity portion of the penalty regarding disclosed violations. EPA did not assess an economic benefit penalty. Consistent with the purposes of the Audit Policy, EPA expects Halcon to institute the internal practices and procedures necessary to prevent reoccurrence.
