Case summary

On September 2, 2015, EPA Region 6 issued an Administrative Order (AO) under its authority pursuant to Sections 308 and 309 of the Clean Water Act (CWA) to Rocky Top Energy, LLC (Respondent) located in Henryetta, OK. The AO was issued in response to an unauthorized produced water discharge which resulted in a violation of the CWA. The AO requires the Respondent to: (1) cease immediately any continued discharges of pollutants from the facility; (2) remove all pollutants from the flow path located between the facility and the discharge point of entry into the tributary; (3) remove sufficient amounts of produced wastewater, which was discharged from the facility on or about July 23, 2015, from the tributary so that the tributary is at or below background salinity levels; and, (4) submit documentation to the EPA. The Respondent must respond to EPA Region 6 within 30 days of receiving this AO.
