Case summary

On April 15, 2015, EPA Region 6 issued an Administrative Order (AO) under its authority pursuant to Sections 308 and 309 of the Clean Water Act (CWA) to Chaparral Energy, LLC (Respondent) located in Gainesville, Texas. The AO was issued in response to an unauthorized produced water discharge to a water of the United States. The AO requires Respondent to (1) Immediately cease all discharges of pollutants from the facility; (2) remove all pollutants from the flow path located between the facility and the discharge point of entry into the tributary; (3) remove sufficient amounts of produced wastewater which was discharged from the facility on or about March 26, 2015, from the tributary so that the tributary is at or below background salinity levels, ; (4) remove all crude oil from the tributary which was discharged from the facility on or about March 26, 2015; and (5) submit written documentation to the EPA.
