Case summary

On October 24, 2014, EPA Region 6 issued an Administrative Order (AO) under its authority pursuant to Sections 308 and 309 of the Clean Water Act (CWA) to H & H Tank Cleaning (Respondent) located in Union County, Arkansas. The AO was issued in response to an unauthorized produced water discharge resulting in a violation of the CWA. The AO requires the Respondent to: (1) immediately discontinue any unauthorized discharge of pollutants; (2) remove all produced water from the flow path located between the facility and the discharge point of entry into the tributary of Holmes Creek; (3) remove all produced wastewater from the tributary of Holmes Creek; and, submit written documentation in the form of certification. The Respondent must respond to EPA Region 6 within thirty days of receiving this AO.
