At all time relevant to this Order, the facility acted as a point Source of a discharge of Pollutants to the receiving waters of Island Bayou which is considered a water of the United States . On July 11, 2012, the facility was inspected by the EPA. The inspector observed deficiencies (Severe slumping & danger of sidewall collapsing) at lagoon #4 and possible overflow of lagoon #3.
