Case summary

On January 12, 2015, EPA Region 6 made final the Proposed Administrative Order (PAO) under its authority pursuant to Section 1423 of the Safe Drinking Water Act to Performance Energy Resources, LLC (Respondent) located in Barnsdall, Oklahoma. The Final Order was issued in response to the following violations: (1) failure to plug injection wells within one year after termination of injection operations; and (2) maintaining injection wells in a manner which could allow fluids to move through the well bores into underground sources of drinking water (USDWs). The PAO requires Performance Energy Resources, LLC, to either (1) plug the wells or (2) submit plans for their future use to the EPA, including proposed procedures to prevent contamination of USDWs.
