Case summary

A Consent Agreement and Final Order was filed with MarkWest Javelina Company on August 29, 2013, in order to address and resolve outstanding Clean Air Act violations at the Corpus Christi, Texas off-gas processing plant. The primary issues were not meeting the minimum heating value for the gas stream sent to the flare and exceeding the allowable visible emission limits at the flare. MarkWest Javelina is required to pay a civil penalty of $97,500. The company is required to spend at last $650,000 to enhance reliability of the Sulfur Recovery Unit and/or the incinerator, improve emission controls and reduce flaring and emissions to the air. Additionally, MarkWest Javelina will increase communication with the community and support community emergency planning projects.
